So as of now, He paid you 389 for the Indian head, and the bid is 330.
Plus, he paid for grading. Unless the bid goes way higher, he is losing money.

Fleeting thought... So proud was the engraver of his handiwork, that he departed from long-standing custom and subtlety etched his SSN unobtrusively on the upper half of the rising sun on the obverse. (Even the footwear is unique.) I double-dare any member, irrespective of experience and supporting documentation, to produce for viewers a finer strike -- strikingly devoid of a hint of a single bag mark, much less wear. 😉
That little tick under the OF would preclude a 70. There is also a mark above the rightmost ray on the obverse. And several marks on her right arm. Nice coin though. I love walkers! Many have this "halo" on the obverse.

I won this one at a coin club auction for 10 dollars several years back. It is a really nice coin, but was hard to photograph as it is still in the plastic holder it came in from the mint.

I bought this one in an old NGC holder graded MS61. I knew it was undergraded, but was looking for a nice 7070 Type 1. I popped it out of the holder and it now resides in my 7070. I have thought about having it regraded, but did not since I like it where it is!

I have carefully cracked out quite a few NGC slabs for my Dansco 7070 and other albums. I assure you, there would be quite a bit more damage than that little crack. Looks like it was just dropped.
Even the best crack out I did was quite damaging to the seam area.
If you like the coin, keep it. If not, just send it back.
