Great post! I had not seen the articles in Newsweek. IMHO Ebay has been turning their back on buyers and small sellers since they began. Many so-called "power sellers" on Ebay are almost never censured or punished, even for selling practices that I would call outright deceptive. I have become very wary of buying any coins on Ebay from anyone that I do not know, or have not done business with in the past.

If this lawsuit does follow through, I think it should give a legal remedy to use of the "Electronic User Agreement" which is growing so popular in the internet generation. Ebay can defend themselves since every user when they sign up must click that they have read and agree with all of the term and conditions of the site. However the plantiffs in the case can argue that ebay did not do a sufficent job of monitoring users and holding them to their argrement.

 

Maybe this case will finally spell out exactly what a user agreement means for both the company issuing the agreement and the consumer signing the agreement.

 

I think ebay will win the case in the end, but will still take a major hit finically and be forced to reform the site. In my opinion ebay just got to big to quick and the company couldn't keep up with the increase in size.

 

Here are a few lines from the user agreement

 

We are not involved in the actual transaction between buyers and sellers. As a result, we have no control over the quality, safety or legality of the items advertised, the truth or accuracy of the listings......

 

6.2 Restricted Activities. Your Information (or any items listed) and your activities on the Site shall not: (a) be false, inaccurate or misleading; (b) be fraudulent or involve the sale of counterfeit or stolen items;

Ebay cares very little about the buyer. I had to file a claim with Paypal on a seller who wouldn't deliver ( not a coin dealer) and through an exchange of emails I felt that the seller who mysteriously went out of business or should I say just uses another ID now is part of a group. I sent copies of the email from the seller which showed the different ID to Ebay and they did nothing. The other id even has the same feedback responses as the other one. ( I didn't know what feedback was at the time) Ebay hides behind the privacy clause and hiding behind "We are not the seller only the site the seller uses" or something like that. However, out of all of my purchases I have had only one problem and that was my fault for not paying attention to the feedback which I now read. Paypal on the other hand resolves the issue quickly.

I've been successful in the past in rooting out shill bidders. When I've presented

eBay with the evidence, we had more "not a registered user" id's within the day.

I can't say that they are entirely without concern over there.

Spy, THANKS for the excellent articles. It's about time these issues of fraud were brought to the forefront. Sleaze runs rampant on eBay, and it wasn't always like that, but that's why I can't stand to even browse listings any more (as a bidder).
