Hi everyone

I have a seller who has become less than responsive to a reasonable resolution to refund a measely $19.16 cents! The guy used a trumped up description to sell a coin and it's not anything close to how he described it.

The seller claims the return policy has expired! Of course, I would believe that if he had one listed. He also claims to be an ANA member, which, if I'm correct, requires a 30 day return policy.

In one of his emails, this guy tried to buy me off for five bucks! 27_laughing.gif

In response, I reminded him how he misrepresented the coin, that I'm due a full refund including an additional $6.95 to cover cost of returning the coin by priority mail, ins., and signiture confirmation.

I have yet to hear from this guy!

 

Sellers title and description;

The following emails are from the beginning to the last sent with no response;

I received your coin the other day and I believe you have sent me the wrong coin!

For beginners, the coin is not PROOFLIKE and in your description you said all of the following things about this coin;

PERFECT RARE, FINEST SPECIMEN, IT IS WITHOUT FLAW, ABSOLUTELY NO SCATCHES OR MARKS.

This coin has a large nick by the eye!

I will need to return this coin for a full refund, please advise!

 

His response,

Leo, "You state the other day" More like at least a

week and a half ago!!!!

I state "Proolike" not Perfect Uncirculatated MS70 per the

Red Book (pg. 8, 2005 Edition) and it is rare to get a non-proof

xx in this condition.

I saw no nicks or scratches using a 10x and the steps are a perfect

5 when I shipped it back on Sept. 3rd. or 4th. Of course I have to be just

a little concerned that it took you so long to contact me. A couple of days after

receipt is more reasonable, not 11/2 weeks??.

I've sent out a second chance offer to the next highest bidder (.50c) lower

than your bid. If they accept it (which I doubt because you took so long

to complain, I'll work it out with you for a refund upon return, providing the original

packaging hasn't been tampered with (I will be able to tell).

That's the best I can offer under these cicumstances. Lets see what happens, I don't want to exchange negative feedback with you so lets be reasonable. Your the

first customer I've refused to immediately say send it back, but you have

really put me on the spot taking your time to notify me.

Thank you for the reply! Here is the coin with the nick by the eye! I was going to eat the thing until I realized that I have almost $20 into the thing. I'll need to put more into it to send it back. I can understand how you could have missed this nick, it happens. But your description of the coin says otherwise! The reason why I bought the coin was based on your description of the coin.

Hello Leo:

Thank you for replying in a civil manner. My concern was it took

too long for you to register your complaint with me. I did send out a

second chance offer to the next lowest bidder and as i told you

it probably would get no response which is what happened. (bid was $15.50).

if you check my feedback you know i'm as honest as can be, after some thought

i've come up with this and i hope it is agreeable. you have the coin and you

say it has nick in the eye area, you know it is uncirculated and if their is a

nick it could be and would have to be a nick from the minting process which

is totally acceptable in grading the coin in the hi-ms grade. it has full steps

and a clear planchette, definetly a first strike. i listed the coin for 9.99 and like you have incurred some expenses in doing business. on my side, listing charge, S&H cost

and since you paid with Paypal it was close to $1.00 for their cut. This is my offer

which I feel is very reasonable: You keep the coin which you can sell easily for

$10.00, and I will refund you $5.00 via Paypal which saves us both shipping.

Without looking at the coin I can't see this nick and i still don't understand

your delay in letting me know.

Hope this proposal is O.K. with you and we can both give ourselves

positive feedback.

I have sent you a picture of your coin in the last reply, you must have missed it, here it is again. Please see attached picture. As you can easily see, there is a the big nick by the eye and the coin is not "prooflike". Because your description

in (is a) clear misrepresentation of the coin, I am due to a full refund plus the additional cost that I'll need to pay in returning this coin. How would you like me to return your coin? Small business envelope? Insured? Written confirmation notice? Please advise!

S&h since we both incur expenses, that is normal with

Ebay auctions. Seems you don't know too much about

returns. Second of all, I am not accepting a return on this

item because of your 10 day delay of notifying me.

I rarely leave negative feedback. There's a simple solution here but you continue to ignore the fact that you misrepresented a coin. I've sent you pictures of the coin and you have decided to ignore them as well. Perhaps your selling tactics would be an interesting subject of debate on a couple of major forum boards!

I also would like to add, no where in your auctions do you state that you have a return policy. I did find one that said; "I'AM A ANA MEMBER WITH 100% FEEDBACK"

As an ANA member, the return policy is 30 days!

Please refund my $19.16 plus an additional estimated $6.95 in return mailing fees through Paypal BEFORE I return your coin!

The PO here does not allow coins to be sent in a plain white business envelope.

I apologize, this is the best I can do with the PO.

Personally, the coin is not worth your trouble. It grades at best MS64 with that nick by the eye. I can tape the coin inside of a similar envelope and throw a couple of stamps on it to save you money. But of course, I can't be responsible if the coin gets lost in the mail. Please advise!

I actually see both sides of the argument. You shouldn't have waited to contact him and he should have been more careful with his description of the coin. I personally felt that his refund of $5.00 was a fair offer, but I know how it is to receive a coin that's overgraded.

 

For me the $20 bucks wouldn't be worth the hassle as most dealer aren't going to want to eat the cost of the fees, shipping etc. It is pretty clear that you are the delaer are not going to see eye to eye on this one so you are either going to have to eat the cost of the coin and leave negative feedback or accept the $5.00 bucks.

 

I don't see any alternatives, because the seller isn't going to send you like $27.00 bucks and then wait for the coin to be shipped back. 893scratchchin-thumb.gif

He should have thought about that before he dreamed up all that crrap about the coin. The picture was dark, I should have known better but I'm a sucker for prooflike coins. If the coin was prooflike than I would have overlooked the nick.

The time it took me to notify the seller doesn't play here! The seller has clearly misrepresented the coin! I've also sent two pictures of the nick and the guy has ignored them. This is really not worth my time or effort either but then again the internet is full of these scammers.

The coin is not worth $10 as he outlined in his resolution, there's no way I can get that if I were to sell it. The coin doesn't even have full steps! And I have yet to tell him that! There are two melds and a nick on the steps! See attachment! I already have the ball rolling in two ways, hopefully he'll wise up and do the right thing.

I agree about the steps, but fat chance e is going to wise up. He all but told you to leave him negative feedback if you don't like his resolution.

 

I know you don't think the delay in contacting him maters, but I am curious why you would wait??? Did you not open the package for a week or did you just feel it didn't warrant your prompt attention?

 

I personally wouldn't hold the time against you if I were the seller, but it is a fair question. 893scratchchin-thumb.gif

Well,

I did receive a refund from the seller..........byway of Paypal that included my S&H fees.........and I still have the coin. I don't want the coin, it grades MS64 at best with no full steps. I'm figuring if the guy wants it back then he will need to send some mailing fees. I still haven't heard from the guy and he has left me no feedback.
